Ophthalmology / Lasik Surgery Malpractice

New York Medical Malpractice Attorneys: Eye Surgery and Eyecare Malpractice

The medical field of ophthalmology has been revolutionized by new tools and medical procedures, including Lasik surgery to improve vision. But new tools and procedures are only as effective as the medical professionals using them. It still requires a skilled ophthalmologist to diagnose medical conditions, to assess the suitability of treatment options and to provide treatment.

As with other medical doctors, an ophthalmologist’s failure to diagnose a medical condition, improperly advising a patient on an unsuitable type of surgery or failing to provide the proper treatment are instances of medical malpractice.

Examples of Ophthalmology Malpractice

  • Failure to diagnose glaucoma: Glaucoma can be detected with a device that reads pressure within the eyeball. Some patients with glaucoma have a pressure reading at the high end of normal, in the 18-20 range. They still need medical treatment or they will suffer permanent eye damage. If a patient is complaining of symptoms, there are other methods of diagnosing glaucoma.
  • Improper corneal implant: Ophthalmologists have a choice between hard and soft lenses in corneal transplants. For some patients, a hard lens will not work because of the shape of the eye. Using a hard lens for these patients will cause abrasions and vision damage. Due to age or underlying medical conditions, other patients will not be able to use a soft lens. Doctor must use appropriate judgment when choosing which lens to use.
  • Lasik surgery errors: Similar to the corneal implant, not every eye is appropriately shaped for Lasik surgery. The doctor needs to provide a proper assessment of the chances of successful Lasik surgery and must advise the patient correctly if he or she is not a good candidate.
  • Retinal detachment: A retinal check is extremely important to identify macular degeneration with separation of the retina from the back of the eye. If the ophthalmologist fails to do the test or does it improperly, degeneration will not be detected and the patient can lose his or her eyesight.
  • Errors in cataract surgery
