Work covered under Sections 240, 241 and 241-a of the New York Labor Law includes construction, repair, alteration, painting, cleaning or pointing of a building or man made structure. Man made structures include bridges, water towers, airplanes, utility poles, boats, locomotives, satellite dishes, roads, piers, large pieces of machinery, boilers, air-handling units and even landfills.

  • All types of construction workers are covered by these laws: framers, ironworkers, excavators, masons, laborers, engineers, architects, surveyors, painters, carpenters, roofers, electricians, plumbers, millwrights, and crane and heavy machinery operators.
  • Covered workers can also include cable television and utility workers repairing transmission lines, HVAC workers replacing air-conditioning units, commercial window washers, maintenance workers installing new fixtures, and cleaning crews in a non-residential setting.
  • Workers from other states are covered if they were working in New York when injured.
  • Undocumented workers / illegal immigrants are also covered.
