What is Medical Malpractice?
The term "malpractice" means professional negligence. "Medical malpractice" is the negligence of a health care provider, hospital, clinic or pharmacy. Medical malpractice is not the same as a bad outcome. Surgery and medications are risky, diagnosing an illness is complex and childbirth can be complicated. Sometimes things go wrong even with the best of care.
In order for a bad outcome to have been caused by medical malpractice, the health care provider must have failed to "act in accordance with accepted medical practice." We work with a network of medical experts to bring medical malpractice cases forward to settlement or to trial. We handle all types of medical malpractice, including:
- Obstetrical malpractice, causing birth injuries to a child (such as cerebral palsy, shoulder dystocia, Erb's palsy and brachial plexus injuries, hypoxia and brain damage) and injuries to the mother (VBAC), including uterine rupture and infection and Perinatal Infection
- Surgical errors, including ophthalmology/Lasik surgery malpractice
- Emergency room errors, such as failure to diagnose and properly treat heart attack or stroke, failing to identify brain injury and failures to diagnose
- Medication errors, including pharmacy errors, defective and dangerous drugs and anesthesiology errors
- Failure to diagnose illnesses such as breast cancer, lung cancer, prostate cancer, colon cancer and bladder cancer
Our firm handles medical malpractice cases occurring in hospitals and surgical centers, medical malpractice committed in clinics and doctors' offices, pharmaceutical malpractice and malpractice and abuse that occurs in nursing homes. We accept cases involving doctors, nurses, anesthesiologists, pharmacists, radiologists and other medical professionals. We also bring cases against hospitals.
