We had been fighting a battle
with my ob over my son for what seemed like forever. One firm sent us here and we were so thankful! Dan is an amazing attorney and was so gracious to our family.
Powers & Santola proudly accepts referrals from and enters co-counsel agreements with attorneys and law firms throughout the state and nation.
We pay referral fees to other attorneys on cases taken on a contingent fee basis. Under New York State ethics rules, we are permitted to pay referral fees if the referring lawyer assumes joint responsibility for the referred matter.
Rule 1.5 (g) provides: A lawyer shall not divide a fee for legal services with another lawyer who is not associated in the same law firm unless: (1) the division is in proportion to the services performed by each lawyer or, by a writing given to the client, each lawyer assumes joint responsibility for the representation; (2) the client agrees to employment of the other lawyer after a full disclosure that a division of fees will be made, including the share each lawyer will receive, and the client’s agreement is confirmed in writing; and (3) the total fee is not excessive.
As stated above, Rule 1.5 (g) (2) requires that the specifics of the fee sharing agreement must be disclosed to the client in writing and the client’s agreement to the arrangement must be confirmed in writing.
Our commitment to advancing our profession has earned us the trust and respect of our peers. Our attorneys have held elected leadership positions in the American Association for Justice, the American Board of Trial Advocates, the Melvin M. Belli Society, the New York State Academy of Trial Lawyers, the New York State Trial Lawyers Association, the New York State Bar Association, the Capital District Trial Lawyers Association and the Albany County Bar Association.
If you need to refer a case in an area of law that we do not handle or in a geographic area of the State where we don’t believe we can provide service, we will be happy to make suggestions regarding other reputable firms that we would be willing to trust with such matters.
In addition, our Special Counsel, Professor Michael Hutter, accepts referrals of appellate matters.
