Financial Recovery
for Psychological Damage
After Trauma and Injury

While it’s easy for a jury or claims adjuster to understand that a serious injury has occurred when they see the physical effects of broken bones, a wheelchair, or a lost limb, not every debilitating injury is visible. Psychological damage can be just as painful, sometimes more so, than the physical injury.

The symptoms of psychological damage can include:

  • Post-traumatic stress disorder (PTSD)
  • Depression
  • Anxiety and panic attacks
  • Difficulty making decisions or taking action
  • Fear
  • Compulsive behavior
  • Obsessive thoughts
  • Suicidal thoughts, suicide attempts and completed suicide

The psychological distress that follows disfiguring scarring from serious burns, loss of a limb, or loss of a child are life-altering. At Powers & Santola, LLP., we believe our clients deserve to be compensated for the psychological damages they have suffered as well. If your loved one is suffering, contact our upstate New York law office to talk with a personal injury attorney who will understand.

We Work with
Psychiatric Experts

We work with a forensic psychiatrist to identify the psychological effects of personal injury and to present this evidence to a jury or insurance company. Psychological damage can occur after any type of injury, but especially burn injuries and brain injuries, or the loss of a child.

We have handled a number of cases for psychological damage, including these two particularly compelling cases:

  • Our client suffered a devastating brain injury that resulted in “locked in” syndrome. He could not move and appeared to others to be in a coma, but he was not. He simply had no ability to communicate or make any voluntary movement. He was aware of everything going on around him but no one knew he was awake and aware. He was in this locked in condition for several years before he finally recovered functioning. Few people can comprehend the emotional trauma of this state.
  • Another client, an extremely successful business professional and married mother of one, suffered the death of a child, and nearly lost her own life as a result of medical negligence that occurred during childbirth. Within two months she was back to work and seemingly back to normal. In truth, however, things were far from normal. The forensic psychiatrist pinpointed psychological injuries that the mother had denied even to herself, but which took a toll on her. Her emotional pain and distress regularly woke her in the middle of the night and compelled her to drive to the graveyard to visit the grave of her lost child. Her family was largely unaware of this.
